EmploySwipe and its affiliated companies are committed to protecting the personal information of its users. Please read this Privacy Policy (this “Policy”) carefully to understand how EmploySwipe, (“EmploySwipe”, “we”) processes personal information. This Policy describes how EmploySwipe processes personal information of its users and other visitors browsing the Site (“users”) in connection with the Site and other services provided by EmploySwipe and privacy practices that apply to affiliates, influencers, and other collaborators.

By accessing or using www.employswipe.com, the EmploySwipe mobile app, or any other related sites, applications, services, and goods, or any other website operated by EmploySwipe that links to this Policy (each, the “Site”), and by registering for an EmploySwipe account or to our affiliate, influencer, or similar program, you acknowledge that you have read and understood this Policy. This Policy may change from time to time; any changes we make to this Policy will be posted on this App, and we will also take any other steps, to the extent required by applicable law, including notifying you about material changes. Changes to this Policy are effective as of the stated "Last Updated" date. We recommend that you check the Policy periodically for any updates or changes.

  1. Definitions

    1. Personal information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not, and whether the information or opinion is recorded in a material form or not.

    2. Sensitive information means a type of personal information that also includes attributes such as health information, genetic information or biometric templates.

    3. User, you means a person who uses or accesses the Employswipe application.

    4. Employswipe, we, us, our means EmploySwipe Pty Ltd which owns and operates the Employswipe application.

    5. Any other terms specifically referred to in this Privacy Policy will be defined within the relevant section.

  2. Collection of Personal Information

    1. Employswipe collects the following types of personal information from users:

      1. Name, date of birth, contact details including email address and telephone number;

      2. Photograph or image;

      3. Employment history including current and previous positions held, skills and experience;

      4. Education details including qualifications obtained.

    2. Employswipe does not collect sensitive information as defined under the Privacy Act 1988 (Cth), such as health records, financial information or criminal records.

    3. Personal information is collected directly from users when they:

      1. Create a user profile on the Employswipe application;

      2. Apply for jobs listed on the Employswipe application;

      3. Message or communicate with other users via the Employswipe application.

    4. In addition, Employswipe automatically collects the following types of personal information through a user's use of the Employswipe application:

      1. Device identifiers and settings;

      2. IP address;

      3. Location information;

      4. Pages visited and searches conducted within the Employswipe application.

    5. Employswipe collects personal information for the purposes of:

      1. Creating and maintaining user profiles within the Employswipe application;

      2. Matching users with suitable job listings and potential employers/candidates;

      3. Allowing users to communicate with other users via the Employswipe application's messaging features; and

      4. Improving the Employswipe application and personalising the user experience.

    6. Users are notified and their consent is obtained at the time personal information is collected regarding the purposes of collection and use of their personal information, as required under the Privacy Act 1988 (Cth).

  3. Use of Personal Information

    1. Employswipe will only use personal information provided by users for purposes related to use of the Employswipe application, such as enabling user profiles and matching, communication between users.

    2. Employswipe may use personal information provided by users for the purpose of direct marketing of its own similar services by electronic means.

3.2.1 Users will be given the opportunity to opt-out of receiving direct marketing at the point personal information is collected and through their user account settings.

3.2.2 Sensitive information will not be used for direct marketing purposes.

  1. De-identified information, which cannot reasonably be used to identify an individual, may be used by Employswipe in aggregate form for analytics and research regarding use of the application.

  2. Personal information may be disclosed to the extent required by any applicable law. Subject to this, Employswipe will take reasonable steps to maintain confidentiality of users' personal information.

  1. Disclosure of Personal Information

    1. We may disclose users' personal information to third party service providers that assist with the operation, functionality and features of the Employswipe application, such as analytics providers and payment processors. Any third party service providers will only be permitted to use personal information as necessary to perform their functions and assist us, and must handle personal information securely and in accordance with this Privacy Policy.

    2. In the event that we go through a business transition such as a merger, acquisition by another company, or sale of all or a portion of its assets, users' personal information will likely be among the transferred assets.

    3. We may disclose users' personal information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to: (a) comply with a legal process or applicable laws; (b) enforce the Employswipe Terms of Use; (c) respond to claims that any content violates the rights of third parties; or (d) protect the rights, property or personal safety of EmploySwipe, its employees, users, and the public.

    4. EmploySwipe may share aggregated and de-identified information that cannot reasonably be used to identify an individual user.

  2. Cookies

    1. Employswipe uses cookies and similar technologies to collect information when users access and use the mobile application. Cookies are small files that store and receive information from users' devices.

    2. Employswipe uses the following types of cookies:

      1. Essential/Functional cookies that are required for core application functionality, such as remembering a user's preferences as they browse pages within the application.

      2. Analytics cookies that collect information about how users access and use the application, such as web pages viewed, links clicked and how long a user spends on each page. These cookies do not collect personal information about users.

    3. Essential/functional cookies are deleted when the user closes their browser. Analytics cookies typically expire after 2 years.

    4. Users can control cookies through their device and browser settings. Most browsers will accept cookies but allow users to decline cookies or alert users when a cookie is being sent. Instructions for managing cookies can be found on browsers' own websites.

    5. Employswipe uses Google Analytics, a web analytics service provided by Google Inc. Google Analytics also uses cookies. Please see Google's privacy policy for details of the information collected by Google Analytics cookies and how it is used.

    6. Employswipe may update the types of cookies used from time to time. Any changes to Employswipe's use of cookies will be notified to users by posting an updated version of this Privacy Policy.

  3. Data Security

    1. Employswipe implements technical, physical and administrative security measures to protect personal information from misuse, interference and loss, as well as from unauthorised access, modification or disclosure.

    2. Technical security measures:

      1. Personal information is stored on secure servers that are protected by firewalls and access restrictions.

      2. Encryption technologies are used to protect personal information during transmission over the internet or other networks.

    3. Physical security measures:

      1. Physical access to Employswipe's servers is restricted to authorised personnel only.

      2. Offices and storage facilities are equipped with security systems like alarms and security cameras.

    4. Administrative security measures:

      1. Personnel are bound by confidentiality obligations and access personal information only on a need-to-know basis.

      2. Regular security audits are conducted to identify and address any security risks or vulnerabilities.

      3. Incident response plans are in place in the event of a data breach. Affected users will be notified about the nature and extent of any data breach.

  4. Access to and Correction of Personal Information

      1. Users have the right to request access to any personal information held about them by Employswipe.

      3. Employswipe will respond to a request for access within 30 days of receipt of the request.

      1. Users have the right to request corrections be made to any personal information held about them that is inaccurate, incomplete, out-of-date or misleading.

      2. To make a request for correction, users should contact Employswipe using the contact details provided below and provide details of the information requiring correction and the correction required.

      3. Employswipe will consider any request for correction and make the correction within 30 days of receipt of the request, unless Employswipe considers the information does not require correction.

    3. Reasons for refusal of access or correction

      1. Employswipe may refuse a request for access or correction if the request is frivolous or vexatious.

    4. Complaints

      1. If a user is dissatisfied with how Employswipe handled their request for access or correction, they have the right to make a complaint to Employswipe or the Office of the Australian Information Commissioner.

    2. Your complaint will be acknowledged within 7 business days and responded to substantively within 30 days.

    3. If you are not satisfied with the response to your complaint, you may make a complaint to the Office of the Australian Information Commissioner.

    4. We will not take any detrimental action in response to a user making a complaint in good faith to us or the Office of the Australian Information Commissioner.

  6. Changes to this Privacy Policy

    1. We may amend or update this Privacy Policy at any time by publishing the amended version on the Employswipe website and mobile application. The updated Privacy Policy will apply between us and the user from the date of publication.

    2. We will take reasonable steps to notify the user of any changes to the Privacy Policy. This may include pushing a notification through the Employswipe mobile application or displaying a notice on the website.

    3. If the user does not agree to the changes in the updated Privacy Policy, they may cease using the Employswipe application and close their user account. Continued use after an update will constitute consent to the updated Privacy Policy.

    4. Prior versions of the Privacy Policy will be made available on request by the user for reference as to the handling of personal information before the changes were made.
